Terms of Service

1. Acceptance of Terms & Eligibility

Welcome to AdoraStay. By accessing, registering, or using the AdoraStay website, mobile application, or any associated services (collectively, the "Platform"), you agree to comply with and be bound by these Terms of Service ("Terms").

  • Eligibility: You must be at least 18 years of age to use this Platform. By using the Platform, you represent and warrant that you have the right, authority, and capacity to enter into this agreement.
  • Account Registration: You agree to provide accurate, current, and complete information during registration (including Google OAuth integration) and to update such information to keep it accurate.
  • Account Security: You are responsible for safeguarding your AdoraStay account and wallet credentials. AdoraStay is not liable for any loss or damage arising from your failure to protect your account.

2. Role of AdoraStay (Intermediary Status)

AdoraStay operates strictly as a technology intermediary as defined under Section 2(1)(w) of the Information Technology Act, 2000 (India).

  • We provide a digital venue connecting users who wish to rent/buy properties or items ("Lenders/Hosts") with users looking to rent/buy them ("Borrowers/Tenants").
  • No Agency: AdoraStay is not a real estate broker, agent, property manager, or retailer. We do not own, manage, or control any of the listings on the Platform.
  • Disclaimer of Liability: Any rental agreement, lease, or transaction is strictly between the involved users. AdoraStay is not a party to these contracts and disclaims all liability arising from disputes, damages, or breaches of such contracts.

3. Real Estate Listings (PGs, Flats, Commercial)

For users listing or seeking real estate on the Platform:

  • Accuracy of Listings: Hosts must ensure that all details (rent, amenities, photos, availability) are 100% accurate. Misrepresentation may result in an immediate permanent ban.
  • Legal Compliance: Hosts are solely responsible for ensuring they have the legal right to rent out the property and for complying with local municipal laws, society rules, and police verification requirements.
  • Off-Platform Agreements: AdoraStay strongly advises both parties to execute a legally binding Rent Agreement and register it as per state laws. AdoraStay takes no responsibility for eviction proceedings, unpaid rent, or property damage.

4. Peer-to-Peer (P2P) Item Sharing & Buying

For users exchanging everyday items (electronics, books, tools, etc.):

  • Item Condition: Lenders must accurately disclose the condition of the item, including any existing defects. Borrowers must inspect the item upon handover.
  • Liability for Damage or Loss: The Borrower assumes full financial responsibility for the item from the moment of handover until it is returned. If an item is lost, stolen, or damaged beyond normal wear and tear, the Borrower agrees to reimburse the Lender for the fair market replacement value.
  • Security Deposits: Lenders may require a refundable security deposit. This deposit is held to protect against damage. AdoraStay reserves the right to mediate disputes regarding the withholding of security deposits.

5. Payments, Fees, and AdoraStay Wallet

  • Transactions: All payments for P2P item rentals must be processed through the AdoraStay platform to be eligible for our dispute resolution support. Real estate rent payments may be handled off-platform at the discretion of the users.
  • AdoraStay Wallet: Earnings from renting items will be credited to your AdoraStay Wallet. You may withdraw these funds to a verified Indian bank account. Standard processing times (3-5 business days) apply.
  • Taxes: Users are solely responsible for determining, collecting, and remitting any applicable taxes (including GST or Income Tax) resulting from their transactions on the Platform.

6. Prohibited Content and Conduct

You agree NOT to use the Platform to:

  • List restricted items, including but not limited to: weapons, hazardous materials, illegal drugs, stolen goods, adult content, or counterfeit items.
  • Engage in discriminatory practices based on race, religion, caste, national origin, gender, or sexual orientation when renting out properties or items.
  • Circumvent the platform by finding a user on AdoraStay and completing a transaction outside the platform to avoid fees.
  • Upload malicious code, viruses, or use automated scrapers/bots to extract data from the Platform.

7. Dispute Resolution & Governing Law

  • User Disputes: In the event of a dispute between users regarding an item rental, AdoraStay may, at its sole discretion, act as a neutral mediator. However, we are not legally obligated to resolve disputes.
  • Governing Law: These Terms shall be governed by and constructed in accordance with the laws of India.
  • Jurisdiction: Any disputes arising directly between a User and AdoraStay shall be subject to the exclusive jurisdiction of the courts located in Lucknow, Uttar Pradesh, India.
